Amid the recent news of NewJeans announcing the termination of their contracts and ADOR filing a lawsuit to confirm the validity of the exclusive contract, head attorney Lee Ji Hoon from LAW&MORE gave his opinion regarding the case.

In his YouTube video, he analyzed the case and revealed his thoughts about the group name.
“If they continue activities, they need to change their name first. They shouldn’t be using the name. NewJeans claims they have legitimately notified ADOR of the termination based on the contract. Then, the copyright, trademark, and intellectual property rights in the contract are with ADOR.
This means they should give back the name of NewJeans. At the very least, they should be consistent with their claims. If they continue to use the name, liability for damages may occur.
However, this can also mean they will take back the name through legal action. We also need to look at the contract to see whether or not they can continue activities. That way, the risk will be less.”

He also felt that the claims by NewJeans weren’t sufficient enough to call for contract termination.
Considering there are different interpretations on what behavior interfered with their activities, it is difficult to say the contract is terminated. If the claims of interfering with their activities were the six requests NewJeans sent, in my opinion, it is difficult to see it as a contract termination. Although they claim the contract has been terminated, I don’t think it is.

He also added that NewJeans claims that they have no intention of paying penalty fees. he stated, “But they have to pay. It will be difficult for society to accept if they create a situation where they have to pay and say they have no intention of paying. Although they don’t want to give a single penny, they will have to. This is the group’s legal risk.”
Recently, the Korea Entertainment Producer’s Association called out the group for leaving a negative impact on the industry.
